      Cumberland County, Virginia 420-423 (1757) This Indenture made the twentyth Day of August in the year of our Lord God One Thousand seven hundred fifty seven Between John Maxcey Senr and Sarah his Wife of St. Anne Parish in the County of Albemarle and Silvanus Maxcey and Edward Maxcey (sons of the said John Maxcey Senr and) of the aforesaid Parish and County (and their wives Mary and Judith) and John Maxcey Junr (son of William Maxcey) of Southam Parish in the County of Cumberland of the other part Witnesseth that the said John Maxcey Senr and Sarah his Wife Sampson Maxcey and Mary his Wife and Edward Maxcey and Judith his wife for and in Consideration of the sum of Thirty Pounds current money of Virginia to them in hand paid by the said John Maxcey Junr son of William Maxcey on or before the sealing and delivery of these records the Receipt whereof they hath hereby acknowledged and confirmed and each of them hath granted bargained sold aliened released and confirmed and by these presents do and each of them doth grant bargain sell alien release and confirm unto the said John Maxcey Junr and to his heirs and assigns forever all that Plantation tract or Parcel of Land whereon the said John Maxcey Senr formerly denoted containing Three hundred acres be the same more or less being part of a Tract of Land formerly granted unto xxxxxxx Edward Maxcey as a Patent bearing date the twenty fourth day of March 1725 lying and being on the south side of James River on Matthew's Branch in the County of Cumberland; and is bounded as followeth Beginning at the Back line a Corner Black Oak a Corner Pine and a Hickory (on the North Branch of Jones Creek) thence to the Mouth of School House Branch to a Corner Pop___ and Black Gum thence down the Main Branch to a Corner Black Gum the other remaining part of the said three hundred acres (being one hundred acres the sd John Maxcey Senr bought of his brother William Maxcey Beginning at a corner White Oak upon Matthew's Running South Course to a corner Pine of Hickory up from the Mouth of (Polonin's?) Branch to Peter Boccard's line to a Ash along Baccard's line to a white oak thence to a Corner White Oak and Maple to Boccard's line and Edward Maxcey down the said Maxcey to the firth Station With all Houses Edifices Buildings Yards Orchards Woods Underwoods Water Courses Proffits Commodities Hereditaments and Appurtenances whatsoever to the said Plantation Tract or Parcell of Land belonging or in any wise appertaining and all the Estate Right Title Property Claim of demand whatsoever of them the said John Maxcey Senr Sampson Maxcey and Edward Maxey and their Wives abovementioned or other of them of in and to the same and all Deeds Evidences & Writings touching on or any wise concerning the said premises hereby granted and Released. To have and to hold the said Land Premisses herein before mentioned or intended to be hereby granted released and confirmed with their and every of their appurtenances unto the said John Maxcey Junr his Heirs & Assigns to the only proper use and behoof of him the said John Maxcey Junr and of his Heirs and assigns forever and the said John Maxcey Senr Sampson & Edward Maxcey and their said Wives Sarah Mary & Judith for themselves their Heirs Executors and Administrators doth Covenant bargain and grant to and with the said John Maxcey Junr his heirs and assigns by their presents that the said John Sampson & Edward Maxcey now at the time of the sealing and delivery of these Records ____ seized of a perfect and indefiance the Estate of Inheritance In Simple of and in the said Plantation Tract or Parcel of Land and Premises hereby granted and released without the Lawful let said Intermission or residence of them the said John Maxcey Senr Sampson Maxcey & Edward Maxcey & their said Wives Sarah Mary & Judith - or any other person or persons whatsoever and that free and ____ and souly and clearly acquitted exonerated and discharged or otherwise by the said John Maxcey Sampson & Edward Maxcey their Heirs Executors & Administrators saved harmless and hep'd Indemnified for from and against all former and other Gifts Grants Bargains Sales Leases Intacts Domains Joinders & all other Incumbrances whatsoever and extensions that they the said John, Sampson & Edward Maxcey their Wives Executors and administrators and all and every other Person & Persons having or Lawfully claiming any Estate or Interest of in or to the said Plantation Tract or Parcell of Land & Premises herein mentioned or intended to be hereby Granted & Released or any part thereof by, from or under them shall and will from time to time and at all times hereafter upon the reasonable request and at the costs of charges in the ____ of the said John Maxcey Junr his Heirs & assigns make do execute or cause to be made same & executed all and every such farther and other Lawful and Reasonable not and ___ thing & things Devices Conveyances & appurtenances in the Law whatsoever for the mere _______ & absolute conveying & ______ing the Plantation Tract or Parsall of Land & Premises with their appurtances unto the said John Maxcey Junr his Heirs & assigns as by the said John Maxcey Junr his Heirs or assigns ___________ or their boun___ le__ined in the law shall be lawfully ___________________________ and Lastly that _______ said John Maxcey Sampson Maxcey and Edward Maxcey their Heirs the _____ Land & Premises and every part & parcel thereof unto the said John Maxcey Junr his Heirs & assigns against the Claim Title and ________________ of all and every Person or Persons whatsoever shall and will Warrant and forever defend by these Presents.
