      I Joshua Stockton clerk of the Court for the County aforesaid certify that this deed of conveyance from Edmond Pettis & wife, Ackley Day, Sarah Day, Peter G. Oliver & wife & Saunders P. Day; to Lewis Day was produced before me on the 10th day of October 1822. and the same being shown explained to Mary Oliver wife of Peter G. Oliver she declared that she freely & voluntarily & without the threats or persuasions of her husband signed sealed, acknowledged & delivered the same as her act and deed- an on the 18th day of November following it was proven by the oaths of Truman Day & Catherine Day two of the witnesses thereto to be the act & deed of the other grantors & is recorded Given under my hand this 18th of November 1822 Joshua Stockton
      This Indenture made this 20th day of March in the year of our Lord, one thousand eight hundred and twenty two between Edward Pettis and Mary his wife to Ackley Day and Sarah his wife and Peter G. Oliver and Mary his wife and Sanders P. Day of the county of Fleming and Commonwealth of Kentucky on the one part, and Lewis Day of the county and Commonwealth aforesaid of the other part, Witnesseth: That the said Pettis & wife and Day & wife & S.P.Day for and in consideration of the sum of one hundred Dollars each current money of Kentucky, to them in hand paid, the receipt whereof is hereby acknowledged; has granted, bargained and sold, and by these presents do grant, bargain, sell and confirm, unto the said Lewis Day his heirs and assigns, all that tract or parcel of Land, situate, and being in the county of Fleming on the waters of Locust Creek containing one hundred and fifty acres being the same conveyed by James Crawford commisioned undere a decree of the Fleming circuit court in the chancery suit of Days Heirs against Oxleys, heirs each of the aforesaid first named parties owning and claiming an undivided interest of one tenth of said tract of Land. The entire boundary of which is as follows, Beginning at two black oaks in the line of John Mosby survey, thence west 174 poles to three beeches, corner to Daniel Ficklin, thence south 133 poles with Ficklins line to a beech and elm, thence East 174 poles to three sugartrees in the line of Mosby and with the same North to the Beginning. Together with all and singular, the premises thereunto belonging, or in any wise appertaining: to have and to hold their respective interest hereby conveyed in said tract of land and the appurtenances, into the said Lewis Day his heirs and assigns forever: And the said Edmond Pettis and wife Ackley Day & wife & Peter G. Oliver & wife and Sanders Day for themselves their heirs, executors, and administrators, the aforesaid tract of land and premises, unto the said Lewis Day his heirs and assigns against the claim or claims of all and every person, or persons whatsoever claiming under them, but no further do and will forever defend, by these presents. In witness whereof, the said Edmond Pettis & Peggy his wife Ackley Day & Sarah his wife Peter G. Oliver & Mary his wife and Sanders Day hereunto set their hand and seal the day and date first above written

      From the 1884 Audrain Co. History book:
      About the year 1832, the few families that had located in what is now the southern part of Audrain county and the northern portion of Callaway county, concluded to build a school house. Matthew Scott, Temple Wayne, Thomas Boyd, Mrs. Jane Gregg, Ackley Day and Lewis Day were the parties who led off in this important enterprise, and by their united efforts a house of small round logs was constructed on the north-east corner of section 35, 2 township 50, range 9. It was covered with four-foot clapboards, and had a dirt floor. Linn logs, split open and hewn on one side, made the seats, and a piece hewn and laid on stout wooden pins or pegs, driven into augur-holes bored into one of the logs, constituted the writing bench. The teacher employed was Archibald Gregg. This was the first school taught within the present limits of Audrain county. The teacher was fond of his gun and dog. One day at noon (having his gun at the school-house), he went into the woods and killed a wild-cat. It was a great curiosity to the pupils.

      Also, from the same book:
      The next term of the court commenced March 20, 1837, all the judges being present. Ackley Day was appointed commissioner to lay off the town of New Mexico, and dispose of the lots.
      On the 5th day of November, 1837, the commissioner for the sale of lots presented his sale-book of the same. The record in reference thereto is as follows : - This day, Ackley Day, town and county commissioner, presented his sale book of town lots, which was examined by the court and or-dered to be recorded.
